1. Purpose and acceptance
These general terms and conditions govern access to and use of the website devdevices.com and of the Dev Devices remote access and device management platform (hereinafter, "the Service").
Creating an account, purchasing any plan, or simply using the Service implies the full and unreserved acceptance of these terms in the version published at the time of access. If you do not agree with them, you must not use the Service.
2. Service owner
The Service is provided by Dev Devices (hereinafter, "Dev Devices", "we" or "us"). You can reach us at help@devdevices.com.
3. Description of the service
Dev Devices is a cloud platform that allows companies and professionals to remotely connect to, control and administer computing devices, with a particular focus on fleets of Android TV, Amazon Fire OS and digital signage devices. Its features include real-time screen control, file transfer, execution of automated tasks, organisation into groups and report generation.
The Service is provided under the software as a service (SaaS) model. No physical media are delivered and no ownership of the software is transferred.
4. Registration and user account
To use the Service you must create an account providing truthful, accurate and up-to-date information. The user is solely responsible for:
- The confidentiality of their access credentials.
- All activity carried out from their account.
- Notifying us immediately of any unauthorised use they detect.
We recommend enabling two-factor authentication, available at no additional cost on all plans. Dev Devices may temporarily suspend an account when it detects reasonable evidence of unauthorised access or fraudulent use.
5. Licensing model
The Service is sold through per-device licences. Each device connected to the platform consumes one licence, regardless of the number of technicians who access it.
- Individual licence: from 1 to 9 devices.
- Team licence: from 10 to 50 devices.
- Fleet licence: more than 50 devices.
The number of technicians with access to the platform is unlimited on all plans. Licences are issued in the name of the contracting entity and may not be resold, sublicensed or transferred to third parties without prior written authorisation.
6. Acceptable use
The user undertakes to use the Service in accordance with the law, good faith and these terms. The following is expressly prohibited:
- Accessing devices over which the user does not hold ownership or the express authorisation of the owner.
- Using the Service to monitor people without their knowledge or a legal basis supporting it.
- Using the platform to distribute malware, carry out cyberattacks or gain unauthorised access to third-party systems.
- Reverse engineering, decompiling or attempting to obtain the source code of the software.
- Circumventing the technical licence limitations or the platform's access controls.
- Reselling the Service or providing it to third parties without a signed distribution agreement.
- Deliberately overloading the infrastructure or interfering with its normal operation.
Breach of this clause entitles Dev Devices to suspend or cancel the account immediately, with no right to a refund and without prejudice to any applicable legal action.
7. Prices, payment and billing
The applicable prices are those published on devdevices.com at the time of purchase and are expressed in euros. Prices are shown excluding VAT. VAT or the applicable sales tax is added at checkout according to the customer's country.
Our orders are processed by Lemon Squeezy, which acts as our reseller and Merchant of Record. The purchase contract is entered into with Lemon Squeezy, which also handles the payment, the invoice, the collection and remittance of taxes, and refunds. Purchases are subject to Lemon Squeezy's Buyer Terms. Dev Devices at no time has access to your card details.
Subscriptions are billed monthly in advance and renew automatically each month until the customer cancels them. You can cancel at any time from the Lemon Squeezy customer portal (linked from your receipt) or from the VideoSurveillance portal. The Service remains available until the end of the period already paid for, and you will not be charged again.
We may change our prices by giving at least 30 days' notice before the new price applies to your subscription.
Non-payment of an instalment entitles Dev Devices to suspend access to the Service after notifying the user at least 7 calendar days in advance.
8. Withdrawal and refunds
Dev Devices is a service aimed at companies and professionals. Where the purchase is made by a consumer within the meaning of Spanish Royal Legislative Decree 1/2007 (Real Decreto Legislativo 1/2007), they shall have a period of 14 calendar days to withdraw from the contract without needing to give a reason, unless they have expressly requested the immediate start of the service and it has been fully performed.
Refunds are governed by our Refund Policy and are processed by Lemon Squeezy as the Merchant of Record. You can start a request by replying to your Lemon Squeezy receipt or by writing to help@devdevices.com.
9. Availability and support
Dev Devices undertakes to maintain Service availability of 99.9% per month, calculated over the total time of the calendar month and excluding:
- Scheduled maintenance windows, announced at least 48 hours in advance.
- Incidents attributable to the user's connectivity or to their own devices.
- Cases of force majeure and outages of infrastructure providers beyond our control.
Technical support is provided by email at help@devdevices.com. Team and fleet plans have priority support; the fleet plan also includes a dedicated account manager.
10. Intellectual property
All intellectual and industrial property rights over the Service, the software, the "Dev Devices" trademark, the logos, the documentation and the website content belong to Dev Devices or its licensors.
Purchasing a licence grants the user a non-exclusive, non-transferable and revocable right of use, limited to the term of the contract and to the purposes set out in these terms. No other right is assigned.
The data and content that the user stores or transmits through the Service remain their exclusive property. Dev Devices processes it only to the extent necessary to provide the Service.
11. Data protection
The processing of personal data is governed by our Privacy Policy, which forms an integral part of these terms.
Where the user uses the Service to process third-party personal data, they shall act as data controller and Dev Devices as processor, under the terms of Article 28 of the GDPR. At the customer's request, we will enter into the corresponding data processing agreement.
12. Limitation of liability
Dev Devices shall be liable for direct damages actually evidenced that arise from a breach attributable to its conduct, up to a limit of the total amount paid by the user during the 12 months preceding the event giving rise to the claim.
To the extent permitted by applicable law, Dev Devices shall not be liable for indirect damages, loss of profit, loss of data or business interruption.
Nothing in this clause excludes or limits liability for wilful misconduct, gross negligence, personal injury or any other case that the law declares non-limitable.
13. Term, renewal and cancellation
The contract runs for the monthly billing period purchased and renews automatically each month, unless cancelled beforehand.
The user may cancel at any time from the Lemon Squeezy customer portal (linked from their receipt), from the VideoSurveillance portal or by writing to help@devdevices.com. Cancellation takes effect at the end of the period already paid for, during which the Service remains fully operational.
After cancellation, the account data is kept for 12 months to allow a possible reactivation and is deleted once that period has elapsed. The user may request its early deletion or its export at any time.
14. Modification of the terms
Dev Devices may modify these terms for legal or technical reasons or due to changes in the Service. Substantial modifications will be communicated by email at least 30 calendar days before they come into force.
If the user does not agree with the new terms, they may terminate the contract without penalty before those terms become applicable, with a refund of the proportional unused part of the period paid for.
15. Applicable law and jurisdiction
These terms are governed by Spanish law.
For the resolution of any dispute, the parties submit to the Courts and Tribunals of Palma (Illes Balears, Spain), expressly waiving any other jurisdiction to which they may be entitled, unless the law grants a consumer the right to bring or defend the claim before a different court, in which case that court shall have jurisdiction.
If any provision of these terms is declared void or unenforceable, such invalidity shall not affect the validity of the remainder, which shall continue to be fully effective.
